A California father who admitted to having an incestuous relationship with his biological daughter has been sentenced to one year in county jail and three years of felony probation, a decision that has sparked public criticism.
Stephen Vincent Chavez, 41, received the sentence after pleading guilty in May 2026 to one felony count of incest and one misdemeanor count of providing alcohol to a minor, according to the Ventura County District Attorney's Office. He avoided a state prison sentence despite prosecutors seeking the maximum three-year term.
Prosecutors described the case as a serious breach of parental trust and urged the court to impose the longest sentence allowed under the law. However, under an open plea agreement, the final sentence was left to the discretion of Judge Dusty Kawai.
In delivering the sentence, the judge said California law did not support the maximum prison term because Chavez had no prior criminal record. Prosecutors also reviewed the possibility of filing additional charges, including rape, but determined that incest was the only felony offence supported by the available evidence and legal standards.
According to prosecutors, the offence occurred in July 2025 while Chavez's daughter, Makayla Rene Settles, was staying at his home. After a family gathering, Chavez allegedly purchased more alcohol for himself and his daughter before the two engaged in a segxwal relationship.
Makayla died by suicide in December 2025 at the age of 18.
The sentencing has drawn backlash from members of the public, with many expressing disappointment that Chavez was not sentenced to the three-year prison term sought by prosecutors.
